Terms and Conditions

Before you buy

What this isA data-only mobile plan delivered as an eSIM profile.

1. Who we are

eSimphony, Inc., a Delaware corporation, of 12515 SE 74th St, Newcastle, WA 98056, United States. Contact: support@esimphony.global.

2. Your contract

These Terms, together with the plan details shown to you before you order and the Privacy Notice, form your contract with us. The plan details prevail for the plan they describe.

The contract is formed when we send your order confirmation by email. You must have legal capacity to enter into a contract. If you are under 18, you may use the Service only with the consent of a parent or guardian, who accepts these Terms on your behalf.

Nothing in these Terms excludes or limits any right you have under consumer protection law that cannot be excluded by agreement. Where a provision conflicts with such a right, that right prevails.

Contract languages: English, Vietnamese, Chinese, Spanish, French, Portuguese, German, Italian, Indonesian, Japanese, Korean, Russian, Ukrainian, Arabic, Turkish, Polish. The English version prevails unless local law provides otherwise.

3. The Service

We provide eSIM profiles for mobile data connectivity in the territories covered by your plan, an app for managing plans and Balance, usage notifications, and customer support.

We do not provide:

  • Emergency calls. The Service cannot reach 112, 911, 999 or any national equivalent, and does not send your location to emergency authorities. This is inherent to a data-only service and cannot be enabled on request.
  • Voice calls or SMS. Apps that carry voice or messaging over data may work, but we do not guarantee it.
  • A guaranteed level of speed or coverage. These depend on the visited network, your location, your device and network load. Coverage information is indicative.

Validity. Each plan runs for the period stated in your plan details before you buy. Validity periods vary by plan and may change; the period that applies to you is the one shown at the time of purchase. At the end of it the plan ends and unused data is lost unless you have converted it first. We will warn you before it expires. Your eSIM profile stays on your device and can be reused for future plans.

Converting unused data. Before a plan expires you may be able to convert data you have not used β€” into data for another region, or into Balance. A conversion fee applies, and the value of unused data falls as the plan approaches its expiry date. The fee in force and the exact figures for your conversion are shown to you before you confirm. A conversion cannot be reversed.

We supply the Service with reasonable care and skill and in conformity with your plan details. We do not warrant that it will be uninterrupted or error-free.

4. Your account

Keep your credentials confidential, your details accurate, and tell us promptly if you think your account has been accessed without your authorisation. You are responsible for activity under your account, except where it results from our failure to keep the Service secure or from something outside your reasonable control.

5. Devices

You need an eSIM-capable device that is not carrier-locked, on a supported operating system, with internet access at the time of download. We publish a compatibility list and offer a check before purchase. If the device you identified at checkout turns out not to be compatible, clause 9 applies.

6. Prices and payment

Prices are quoted by Moza and shown in your plan details before you order. The price you see is the total you pay β€” we do not add charges at checkout.

Our unit of account is the US dollar. Where a price is shown in another currency, the conversion uses a rate from our payment provider refreshed at least hourly; the rate applied is the one in force when your price is quoted, and you are charged in the currency displayed. Your bank may still apply its own foreign transaction fee.

Payment is handled by our payment provider. We do not receive or store your full card details. Price changes never affect a plan you have already bought.

7. Balance

Balance is stored value in your account, used to buy plans and services from us.

  • It does not expire while your account is open.
  • It can be topped up, and can also be created by converting unused plan data β€” see clause 3.
  • It can only be used with eSimphony, and is not transferable between accounts. It cannot be exchanged for cash.
  • Balance is not normally refundable. We may refund unused Balance at our discretion in exceptional circumstances β€” for example where we have withdrawn the Service, or where an account is closed at our request.
  • Where an order is paid partly by Balance and partly by card, any refund goes first to the card.

8. Cancelling β€” consumers in the EU, EEA and UK

If you are a consumer in the EU, EEA or UK, you have a legal right to withdraw from a distance contract within 14 days.

Because the Service is supplied immediately, you are asked at checkout to request immediate activation and to confirm that you understand you lose that right once your eSIM profile has been downloaded and your plan activated. Once that has happened, the 14-day right no longer applies.

If you have not yet downloaded the profile and activated the plan, you may still withdraw. Email support@esimphony.global, use the app, or send the form in the Annex; sending it before the deadline is enough. We will refund you within 14 days, to the same payment method, at no charge to you.

Refunds after activation are dealt with under clause 9.

9. Refunds and faults

If we cannot deliver. Where we take payment but cannot deliver the plan you ordered, you do not need to ask. Our systems detect the failure and open a refund case. You may instead retry at no extra charge. Where only part of an order was delivered, the delivered plans stay active and we refund the undelivered part. Refunds go to the original payment method; your bank may take a further 5–10 business days to show them.

If something is wrong with the Service, contact us with your order number. We will investigate and, where the problem is ours, put it right β€” by restoring the Service, replacing the plan, or refunding it, as we consider appropriate in the circumstances. Where consumer law gives you a right to a repair, a price reduction or a refund, that right applies and is not affected by this clause.

We do not refund data you have already used, a plan on which any data has been used, loss of service caused by your own device or a carrier lock, coverage or network performance in a particular place, a change to your travel plans, or declined payments where no money was taken. This does not affect the device check in clause 5, or the refunds we give under clauses 11 and 12. Anything else is assessed case by case at our discretion.

10. Fair use and acceptable use

Plans are for your own personal use. Each plan carries the data allowance shown before you buy. Once that allowance is used, data stops; we do not bill you beyond it, and you can buy more at any time.

Plans are intended for travel, not for continuous use in a single country. The territories your plan covers are shown before you buy, and some territories are excluded from some plans.

We operate the Service subject to fair use. Where usage is significantly higher than is typical for the plan, is inconsistent with personal travel use, or places a disproportionate load on a network, we may reduce speeds, apply traffic shaping or limits, restrict use in particular territories, or suspend or end the plan. We will tell you before we do so where it is practical to do that, and always where the law requires it.

You must not use the Service unlawfully, to gain unauthorised access to any system, to disrupt or overload any network, to infringe others’ rights, for fraud, to send spam, or to resell the Service without our written agreement.

11. Suspension and termination

We may suspend the Service to prevent fraud, abuse or unlawful use, where a network operator, regulator or court requires it, where there is a serious risk to network security, where you have materially breached these Terms, or for maintenance. Except in an emergency we will give notice first and tell you how to restore it.

You may close your account or cancel at any time. There is no minimum term and no early termination charge. Unused Balance is dealt with under clause 7.

We may terminate on 30 days’ notice, or immediately for serious or repeated breach or where supply would be unlawful. If we terminate for convenience or withdraw the Service, we refund your unused Balance and the unused portion of any plan.

12. Changes

We may change these Terms, our policies, our prices and the Service at any time. Changes take effect when we publish the updated version, and we will tell you by email or in the app where the change materially affects you.

Continuing to use the Service after a change means you accept it. If you do not accept a change, stop using the Service and close your account. Where a change materially disadvantages you and you close your account for that reason, we will refund the unused portion of any active plan. Price changes never affect a plan you have already bought.

13. Intellectual property

We and our licensors own all rights in the Service, the app, the platform, our trade marks and our content. We grant you a limited, non-exclusive, non-transferable, revocable licence to use them in accordance with these Terms.

14. Privacy and Moza

Our Privacy Notice forms part of your contract.

Moza is an artificial intelligence system, not a person. It configures and prices your plan automatically from your destination, dates and expected usage, together with our pricing rules and costs. It does not score you, profile you, or vary your price according to who you are. The result is an offer you may accept or decline. You can email support@esimphony.global at any time to reach a person, to ask how a price was reached, or to have it reviewed.

15. Our liability

We do not limit our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited or excluded, including your statutory rights as a consumer.

Otherwise, and so far as the law allows:

  • we are not liable for loss of profit, revenue, business, data, or business opportunity, or for any indirect or consequential loss;
  • we are not liable for loss of service, coverage gaps, speed, or interruption caused by a third-party network, your device, a carrier lock, local conditions, or regulatory restrictions in the country you are in;
  • we are not liable for any failure or delay caused by events outside our reasonable control;
  • our total liability arising out of or in connection with this contract is limited to the amount you paid us in the 12 months before the event giving rise to the claim.

If you are not a consumer, you will indemnify us against claims arising from your breach of these Terms or your unlawful use of the Service.

16. Complaints

Contact support@esimphony.global or use in-app support. We will acknowledge your complaint and respond without undue delay. If we cannot resolve it, we will give you our final answer in writing.

17. Governing law

If you are a consumer, this contract is governed by the laws of the State of Delaware, United States β€” but this does not deprive you of the mandatory protections of the law where you habitually live. You may sue us in the courts where you live or in Delaware. We may sue you only in the courts where you live.

United States residents only: disputes are resolved by binding individual arbitration under the rules of the American Arbitration Association, except for qualifying small claims. This does not apply to consumers in the EU, EEA or UK.

If you are not a consumer, Delaware law applies and the courts of Delaware have exclusive jurisdiction.

18. General

We may transfer this contract to another business without affecting your rights; you may not transfer it without our consent. If any provision is unenforceable, the rest continues in force. Delay in enforcing a right does not waive it. These Terms and the documents in clause 2 are the whole agreement about the Service.
